The Wisconsin Supreme Court will hear the plaintiff speak on December 12, exactly 48 hours before the electoral college's vote, after the lower court ruled against Trump.
In a trial that the AP said was "extremely unusual" on December 12, President Trump's team of lawyers will have the opportunity to justify a request to cancel more than 221,000 votes in Wisconsin and overturn victory of Mr. Joe Biden.
Earlier, a lower court judge ruled that there was nothing illegal about the election or the subsequent recount in the two largest counties in Wisconsin.
"The most important thing here is that the courts need to do everything to make sure that the will of the voters wins," said Judge Stephen Simanek.
Mr. Trump quickly sent an appeal after the ruling. His lawyers asked the Wisconsin Supreme Court to issue a ruling before January 6, when the new congress meets to pass the electoral college's vote.
The state electoral college will meet to vote for the presidential election on December 14 and will most likely vote for the winner of the popular vote in that state. In his petition to the Wisconsin Supreme Court, Mr Trump's side said they were calling on electors to vote for the current president instead of Biden.
Mr. Biden won in Wisconsin with a difference of nearly 21,000 votes, or 0.6%. Mr. Trump requested a recount in the two largest counties in the state, Milwaukee and Dane.
Mr. Trump wanted to eliminate early and direct absentee ballots, saying that there was no appropriate written request for these votes; the absentee ballot of those claiming "indefinite detention"; absentee ballots are collected by election officials in Madison parks; and the absentee ballot paper in which the election official fills out the missing information in the envelope.
The Wisconsin Supreme Court refused to accept Trump's lawsuit before it went through the lower courts. A majority of judges also openly questioned whether it would be valid to cancel the vote as Trump wished.
